Acceptance and scope
By visiting an Evalat page, creating an account, joining an institution workspace, purchasing a plan, accepting an assignment, starting an assessment, or otherwise using the service, you agree to these Terms and the documents incorporated by reference, including the Privacy Policy, Cookie Policy, and Refund Policy. If you use Evalat for an institution or other organization, you also bind that organization and confirm that you have authority to do so.
If you do not agree, do not use the service. These Terms form an electronic record under applicable Indian law and do not require a physical or digital signature.
Eligibility, minors, and authority
- You must be legally capable of entering into a binding contract. A learner under 18 may use Evalat only through a parent or lawful guardian, or under an institution-managed process with the required notices and verifiable parental or guardian authorization.
- A person registering an institution confirms that the institution is genuine and that the person is authorized to create the workspace, accept commercial terms, invite users, and manage assessment data.
- You must provide accurate, current information and promptly correct it when it changes. You may not impersonate another person, institution, credential holder, or certificate owner.
The service and role boundaries
Evalat provides role-based assessment workflows for students, educators, institutions, and authorized platform operators. Features may include question banks, exam authoring, assignments, attempts, monitoring signals, results, certificates, public profiles, notifications, billing, support, identity verification, and AI-assisted operations.
Access depends on the assigned role, institution membership, plan, feature availability, and platform security controls. Institution administrators control institution membership and exam publication. Educators control authorized assessment content and academic review. Students control their own credentials and submissions. Urjasoft controls platform operations, infrastructure, providers, quotas, and abuse prevention.
Urjasoft may improve, replace, limit, or discontinue a feature where reasonably necessary for security, law, provider availability, product integrity, or service development. Material changes affecting a paid plan will be communicated through the service or registered contact details where reasonably practicable.
Accounts, assessments, and institutional responsibilities
Account security
Keep login credentials and recovery channels confidential, use only your own account, and notify Urjasoft promptly of suspected compromise. You are responsible for activity performed through your account until you report unauthorized access, except to the extent caused by Urjasoft's breach of applicable obligations.
Assessment decisions
Educators and institutions are responsible for the legality, accuracy, accessibility, academic suitability, marking scheme, publication, scheduling, assignments, accommodations, and final results of assessments they control. Evalat is a workflow platform and is not an examining board, university, school, accreditor, or guarantor of academic recognition unless Urjasoft expressly agrees otherwise in writing.
Student conduct
Students must submit their own work, follow exam instructions, avoid unauthorized assistance, and not interfere with monitoring or integrity controls. An institution or educator, not automated signals alone, determines the academic response to suspected misconduct.
Monitoring and identity
Where enabled, monitoring may record heartbeat, fullscreen, focus, network, and related integrity events. Evalat does not currently enable camera or microphone capture in its assessment monitoring flow. Identity verification is purpose-limited, requires a separate notice and consent, and may use Cashfree Secure ID and DigiLocker or an operator-assisted alternative. Institutions must not use identity or monitoring features for an unrelated purpose.
AI-assisted features
AI features may generate draft questions, suggested answers, explanations, classifications, summaries, or evaluation assistance. Output can be incomplete, biased, inaccurate, unsuitable, or similar to content produced for others. It is not professional, legal, medical, or guaranteed academic advice.
- Authorized users must review AI output before it is used, published, graded, or shared.
- AI output must not be the sole basis for a consequential academic or disciplinary decision.
- Do not submit confidential, sensitive, biometric, financial, identity-document, or unnecessary personal data to an AI field.
- Provider selection, model routing, quotas, and fallback behavior are managed centrally by Urjasoft platform operations. Availability and output can vary by provider.
Content and intellectual property
Urjasoft and its licensors own Evalat software, product design, branding, documentation, templates, and platform materials. Except for the limited right to use the service under these Terms, no intellectual-property right is transferred to you. You may not copy, resell, sublicense, reverse engineer, or create a competing service from protected Evalat materials except where applicable law expressly permits it.
You retain rights you lawfully hold in questions, answers, diagrams, institution materials, profile content, and other content you submit. You grant Urjasoft a non-exclusive, worldwide, royalty-free license to host, reproduce, adapt for technical formatting, transmit, back up, and process that content only as needed to operate, secure, support, and improve the contracted service. This license ends when the content is deleted, subject to backups, audit records, legal retention, and content already shared through an authorized workflow.
You confirm that you have the rights, permissions, and lawful basis needed for submitted content and personal data. Feedback or product suggestions may be used by Urjasoft without restriction or payment, provided they do not disclose your confidential information.
Acceptable use
You must not use Evalat to:
- break any law, violate privacy or intellectual-property rights, harass others, facilitate discrimination, or publish unlawful or harmful content;
- cheat, manipulate results, falsify identity or certificates, access another user's work, or bypass exam, role, quota, payment, rate-limit, or security controls;
- upload malware, probe or exploit the service without written authorization, overload infrastructure, scrape protected data, or interfere with another user's access;
- collect or upload Aadhaar, biometrics, children's data, or other sensitive information outside an expressly provided and lawful Evalat workflow;
- use automated output or platform data to make prohibited profiling, targeted advertising to children, or solely automated high-impact decisions.
Urjasoft may investigate suspected misuse and preserve or disclose relevant records where reasonably necessary to protect users, enforce these Terms, or comply with lawful process.
Plans, payments, taxes, and refunds
- Prices, billing intervals, included limits, introductory pricing, taxes, and renewal terms shown at checkout form part of your order. Unless expressly stated otherwise, displayed prices exclude applicable GST or other taxes.
- A recurring charge will be made only where recurring billing is clearly disclosed and authorized. You must keep billing and tax information accurate and are responsible for charges validly incurred through your account.
- Payments may be processed by an enabled third-party gateway. Urjasoft receives payment status and transaction references but does not require you to disclose a card PIN, UPI PIN, or banking password to Evalat.
- Plan limits, including seats, assessments, storage, and platform-managed AI allowances, may be enforced. Attempts to evade limits may result in suspension or additional charges after notice.
- Cancellations and refunds are governed by the checkout terms and the Refund Policy. Cancellation normally prevents future renewal; it does not automatically reverse services already delivered, taxes, provider charges, or consumed usage.
Third-party services
Evalat may connect to identity, payment, email, notification, storage, OAuth, analytics, and AI providers. A third party may apply its own terms and privacy notice when you leave Evalat, authorize an account, complete a payment, or use a provider-hosted flow. Urjasoft is responsible for selecting and integrating providers with reasonable care, but is not responsible for a third party's independent systems, content, or acts outside Urjasoft's control. Provider outages may temporarily affect a related feature.
Suspension, termination, and account closure
You may stop using Evalat or request account closure through support, subject to institution control, outstanding payments, active assessments, legal holds, and required retention. An institution may remove a member from its workspace without deleting the person's independent account where the product supports continued individual access.
Urjasoft may restrict or suspend access immediately where reasonably necessary to address a security threat, unlawful activity, fraud, non-payment, serious policy breach, risk to an assessment, or a legal direction. Where the issue can be remedied, Urjasoft will ordinarily provide notice and a reasonable opportunity to cure. Urjasoft may terminate access for an uncured material breach, repeated violations, or where continuing the service is unlawful or technically infeasible.
Availability, disclaimers, and liability
Urjasoft uses reasonable care to operate and secure Evalat, but the service is provided on an "as available" basis. Internet, device, institution-network, browser, provider, and force-majeure events can interrupt access. Users and institutions should maintain appropriate contingency plans for high-stakes assessments and export records they are required to retain.
To the maximum extent permitted by law, Urjasoft disclaims implied warranties of uninterrupted availability, fitness for a particular academic purpose, guaranteed detection of misconduct, error-free AI output, or recognition of a result or certificate by a third party.
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, exemplary, or consequential loss, including loss of profit, opportunity, goodwill, or data, where such loss was not reasonably foreseeable. Urjasoft's aggregate liability arising from the affected paid service will not exceed the fees paid to Urjasoft for that service during the 12 months before the event giving rise to the claim.
Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability arising from fraud, wilful misconduct, or mandatory consumer rights. Nothing limits a data principal's rights under applicable data-protection law.
Indemnity
To the extent permitted by law, an institution or business user will defend and indemnify Urjasoft against a third-party claim arising from that user's unlawful content, lack of authority or consent, misuse of learner data, violation of another person's rights, or material breach of these Terms. This does not apply to the extent the claim was caused by Urjasoft's own breach, negligence, or unlawful conduct.
Governing law and disputes
These Terms and any dispute connected with Evalat are governed by the laws of India. Evalat is only a brand; Urjasoft Enterprises Pvt. Ltd. is the party that will receive, manage, defend, settle, or otherwise participate in any complaint, demand, dispute, or legal process relating to the service.
Before starting formal proceedings, contact Urjasoft with the account, transaction, and issue details and allow 30 days for a good-faith resolution, unless urgent relief is reasonably required. Unresolved disputes may be brought before a court or statutory forum of competent jurisdiction in India. This clause does not restrict any non-waivable right to approach a consumer commission, regulator, data-protection authority, or other forum available under applicable law.
Changes and general terms
Urjasoft may update these Terms to reflect product, legal, security, or commercial changes. The effective date will be updated and material changes will be notified through Evalat or registered contact details. Continued use after the effective date constitutes acceptance where permitted by law; fresh consent or acceptance will be requested where required.
If a provision is unenforceable, the remaining provisions continue. A failure to enforce a provision is not a waiver. You may not assign your account or agreement without written approval. Urjasoft may assign the agreement as part of a merger, reorganization, financing, or transfer of the Evalat business, with notice where required.
